What is Export Control Law?

Prior to 1995, the U.S. government maintained very strict regulation of the export of encryption items, hindering the development of online commerce and related international commerce. While these regulations have been relaxed since 1995, the U.S. Commerce Department, the U.S. State Department, and other government agencies still administer a complex set of regulations pertaining to the export of military sensitive and dual use technologies, including encryption items, which have played a key role in establishing and enabling online commerce. Violation of these regulations entails severe civil, criminal, and administrative (loss of export privileges) penalties.

Export Control and the H1-B Visa Program

One area in which the government has applied its export control regulations is in the H1-B visa program. For the past few years, the government has required that companies attempting to bring on an H1-B employee must certify that no export control regulation will be violated in providing technical data to the H1-B employee (a foreign national), pursuant to the “deemed export” rule.
